VISION LICENSING
Short form terms & conditions for stock footage use
1. Stock Footage License Agreement
This License Agreement ("Agreement") is made between Hypervision ("Licensor") and the Licensee ("you" or "Licensee") regarding the use of the images or video footage ("Images or Footage") available on the Hypervision website.
1. Ownership of Images or Video Footage
Licensor and/or its contributors own or control all rights, including copyrights, in and to the Images or Footage. All rights not expressly granted herein are reserved by Licensor and/or its contributors.
2. Grant of License
Subject to the terms of this Agreement, Licensor grants Licensee a perpetual, worldwide, royalty-free, non-exclusive, non-transferable, and limited license to use the Images or Footage for a single commercial purpose. Such purposes include use on websites, webcasts, limited broadcasts, and digital applications. Use of the licensed Images or Footage in any other media, or for resale or redistribution—including broadcast TV or film—is strictly prohibited without prior written consent from Licensor.
3. Resale and Distribution
Licensee shall not resell or make available for sale any footage purchased from Hypervision without written permission from Hypervision.
4. Releases and Legal Responsibility
While most properties and persons are released in this library, Hypervision accepts NO responsibility for releases. It is recommended that faces or identifiable persons are not included without proper releases unless for legally permissible editorial purposes. The entire responsibility lies with the Licensee.
5. Credit Requirements
Licensee is not required to credit Hypervision, except when using the Images or Footage for editorial purposes. In such cases, the credit line “© Hypervision” must be included.
6. Derivative Works
Any derivative works created based on or incorporating the Images or Footage shall remain owned by Licensor or its contributors. Licensee’s rights are limited to the use granted under this Agreement.
7. Modification of License
This license can be amended or customized to meet specific client needs, subject to mutual agreement.
8. General Provisions
In the absence of a signed license agreement, the default license described herein shall apply to all footage.
For Australian clients, this Agreement shall be governed by Australian law, and any legal disputes shall be subject to the jurisdiction of the courts of Australia.
